One DWI, Two Very Different Breath Tests

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Wednesday, October 9, 2013. “The Officer Had Me Blow Twice in My DWI Case” Frequently during new client consultations for DWI cases I hear, “They had me blow twice.” Usually this means the police officer administered a preliminary breath test at the scene, prior to placing my client under arrest, then administered an evidentiary breath tests once back at the station. There are times when no preliminary breath test is given, and other times when the evidentiary breath test takes place […]

Bills Would Give Students Immunity from Underage Drinking Charges

On behalf of The Law Office of Jason A. Korner posted in Underage Drinking on Friday, October 4, 2013. One of the unfortunate realities when it comes to underage drinking and college students is that it often crosses the line from mere experimentation to dangerous overindulgence. Indeed, statistics have shown that levels of binge drinking among college students continue to rise despite the education and enforcement efforts of officials at schools here in Missouri and throughout the U.S. Interestingly, lawmakers in the state of Wisconsin are considering a somewhat novel approach to the problem of underage drinking: granting both academic […]

Missouri law enforcement officers have announced a new tactic to combat drunk driving in the state. Police in St. Louis say they will start using a “No Refusal Zone” technique during traffic stops this holiday season, prohibiting motorists from opting out of Breathalyzer tests. Those pulled over for DWI traffic stops will be required to submit to a blood test if they refuse to take a breath analysis at the scene. A system has already been set up to accommodate […]

Affluenza Defense Prevents Jail for Vehicular Manslaughter

On behalf of The Law Office of Jason A. Korner posted in Felony DWI on Friday, December 20, 2013. They call it “affluenza” — the inability to understand the consequences of your actions because you are simply too rich and entitled. Although it is not an official diagnosis, it was recently used in a successful courtroom defense in the South, allowing a wealthy teen to avoid prison time even though he reportedly killed four pedestrians in a drunk driving wreck. The boy’s blood alcohol level at the time of the crash was three times the legal limit, according to official […]

Cops: Research Intimidation Prevented Breath Test Refusal

On behalf of The Law Office of Jason A. Korner posted in Breath Test Refusal on Wednesday, December 11, 2013. First, imagine being randomly pulled over by the police even though you have not done anything wrong. Then, picture yourself being forced to provide saliva, breath and even blood samples as part of a national transportation research study. That is exactly what is happening in jurisdictions throughout Missouri and the rest of the nation, as the National Highway Traffic Safety Administration conducts a federal research study about drunk driving. At least one municipality in Texas is refusing to participate in […]
