Police Officer in St. Louis Arrested for DWI

On behalf of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Thursday, July 11, 2013. Anyone can be arrested for driving while intoxicated. One night’s mistake, a problem with drugs or alcohol or simply having a single more drink that makes your blood alcohol concentration over 0.08 percent can lead to an arrest for drunk driving. That was demonstrated recently when a St. Louis police lieutenant was arrested on suspicion of DWI. The officer was off duty and in his own vehicle when pulled over by the Missouri Highway Patrol. The officer was […]

DWI Lawyer: Drunk Driving Ads Not Legally Accurate

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Wednesday, July 3, 2013. “Drive Sober or Get Pulled Over.” This is law enforcement’s message to people regarding DWI investigations and arrests. It’s short, it’s cute, and it rhymes, but too bad it’s not the law. Driving sober means not having had anything alcoholic to drink prior to driving. Everyone can agree that sober driving is legal. A person that has ten beers and drives is clearly drunk driving. Everyone can agree that is illegal. The point of contention between lawyers […]

Effects of Missouri Blood-Test Case Begin to Spread

On behalf of The Law Office of Jason A. Korner posted in Breath Test Refusal on Tuesday, July 2, 2013. Earlier this spring, the U.S. Supreme Court handed down a decision that directly impacts the way law enforcement can collect evidence in drunk driving cases. The court determined, based on an appeal originating in Missouri, that police can’t administer warrantless blood tests under most circumstances. Now that that ruling has had time to filter down to local police departments, a number of legal concerns are being raised across the country. For example, law enforcement agencies in Minnesota are trying to […]

Jumping to Conclusions in DWI Cases

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Monday, July 1, 2013. You Are Under Arrest for DWI Because You Must Be Drunk Police officers can jump to conclusions in any type of case, but it is especially prevalent in DWI cases. Anyone pulled over for a traffic offense after midnight is already under suspicion of drunk driving. Often the first question an officer will ask during a late night traffic stop will be, “Have you had anything to drink tonight?” If a person admits to having even one […]

DWI Crackdown Over July 4th Weekend

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Sunday, June 30, 2013. St. Louis area police have announced that there will be enhanced DWI enforcement over the July 4th holiday weekend. Every year the police focus on drunk driving arrests around certain holidays, and with nice weather and good barbeques the 4th of July is always one of those holidays. St. Louis area drivers can expect checkpoints, but drivers can also expect police officers to take a more vigiliant approach towards possible impaired drivers over the long weekend. The […]

One DWI, Two Very Different Breath Tests

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Wednesday, October 9, 2013. “The Officer Had Me Blow Twice in My DWI Case” Frequently during new client consultations for DWI cases I hear, “They had me blow twice.” Usually this means the police officer administered a preliminary breath test at the scene, prior to placing my client under arrest, then administered an evidentiary breath tests once back at the station. There are times when no preliminary breath test is given, and other times when the evidentiary breath test takes place […]

Bills Would Give Students Immunity from Underage Drinking Charges

On behalf of The Law Office of Jason A. Korner posted in Underage Drinking on Friday, October 4, 2013. One of the unfortunate realities when it comes to underage drinking and college students is that it often crosses the line from mere experimentation to dangerous overindulgence. Indeed, statistics have shown that levels of binge drinking among college students continue to rise despite the education and enforcement efforts of officials at schools here in Missouri and throughout the U.S. Interestingly, lawmakers in the state of Wisconsin are considering a somewhat novel approach to the problem of underage drinking: granting both academic […]

Earlier this month, a St. Charles County Circuit Court judge handed down a sentence in a drunk driving case involving a 26-year-old man who was involved in a chain-reaction car crash last summer that resulted in the death of a popular five-term St. Louis alderman. According to court records, the young man was driving eastbound on Highway 370 at around 12:30 a.m. back on August 1, 2012, when he was involved in a minor fender bender with a […]

Underage Drinker Allegedly Passes Out on Stranger’s Couch

On behalf of The Law Office of Jason A. Korner posted in Underage Drinking on Friday, September 20, 2013. A Missouri youth was claimed to have been driving while drunk and crashing his car onto the property of a church.  It is further alleged that he fled the scene, entered a stranger’s home and fell asleep on a couch. The owners of the home called county law enforcement officers to report that they had found this youth in their home.  He was arrested after officers arrived at the home and then released into the custody of his parents.  The young […]
