St. Louis Football Player Accepts Plea Deal in Drunk Driving Case

On behalf of The Law Office of Jason A. Korner posted in Breath Test Refusal on Thursday, May 23, 2013. At this point in the year, the football season may not be on the radar of many people in Missouri. Yet a St. Louis Rams player is likely wondering how the upcoming season will be impacted by the sentence he recently received for drunk driving charges. In April, we covered the arrest and trial of Trumaine Johnson, and he was recently sentenced. Before being sentenced, Johnson apparently made the decision to plead guilty on lower charges in order to receive […]

Man Convicted of DWI After Driving an ATV on Private Property

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Wednesday, May 22, 2013. To be guilty of a DWI in Missouri there is no requirement that a person is driving a car or that he is driving on a public road. A Warren County man was recently convicted of driving an ATV while intoxicated in his friend’s front yard. The man had prior convictions and received a fifteen year prison sentence even though he was never behind the wheel of a car. There are two major issues in this case. […]

By Jason Korner of The Law Office of Jason A. Korner posted in Felony DWI on Monday, May 20, 2013. An Imperial man faces felony DWI charges stemming from an incident where a police officer arrested the man at his home. A Missouri State Highway Patrolman found the man’s wrecked car, but no one was near the car. The officer then ran a search on the vehicle and proceeded to the owner’s house. Once the officer arrived at the man’s house the man admitted to the car accident, the officer conducted field sobriety tests and placed him under arrest. Unfortunately […]

Panel Recommends Decreasing Legal Blood-Alcohol Concentration

On behalf of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Thursday, May 16, 2013. Nearly a decade ago, U.S. Congress prodded states into lowering the acceptable blood-alcohol concentration for drivers to 0.08 percent. Since that time, Missouri has followed along and enforces that limit in drunk driving cases. More recently, however, the National Transportation Safety Board encouraged states to reduce the legal limit even further. According to the panel, the legal limit should be set at 0.05 percent, which is a significant change from the current laws. This move is being suggested […]

DWI Arrests Posted on Twitter by Minnesota State Patrol

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Monday, May 13, 2013. People arrested for DWI will now have their age and gender posted on Twitter by the Minnesota Department of Public Safety. On May 10th the Minnesota Highway Patrol launched a crackdown on drunk driving that included posting the location of all drunk driving arrests along with the demographic information of the person arrested. It appears the original idea was to post the names of the people arrested for drunk driving as a way to publicly shame them. […]

Court Rules DWI Checkpoint Invalid

By Jason Korner of The Law Office of Jason A. Korner posted in DWI Checkpoints on Thursday, August 15, 2013. Recently a judge ruled a sobriety checkpoint invalid in a DWI case because it did not comply with the law. Specifically, the judge held there was a lack of evidence to show the location of the checkpoint had a high rate of drunk driving. Due to the judge’s ruling, all evidence obtained after the stop of the defendant was deemed inadmissible, which essentially ends the prosecution of the defendant. The case will either be dismissed at the discretion of the […]

The New Weapon Against Underage Drinking is a Phone App?

On behalf of The Law Office of Jason A. Korner posted in Underage Drinking on Tuesday, August 13, 2013. The market for smartphone applications or “apps” has exploded over the last few years as web savvy entrepreneurs continue to think of new and increasingly remarkable uses for the average consumer’s smartphone. One demographic in particular that these entrepreneurs are continually trying to target is teenagers, who are uniquely positioned to provide a major marketing push thanks to their social media knowhow. Interestingly enough, one software company recently released an iPhone app that targets teens not from a marketing perspective, but […]

Ninth State Now Permits Saliva Tests at DWI Stops

On behalf of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Friday, August 9, 2013. Law enforcement officials have a variety of tools at their disposal when it comes to combating impaired driving. For example, as we discussed in a post just last week, the Missouri State Highway Patrol frequently deploys both sobriety checkpoints and saturation patrols in an attempt to make the roads as safe as possible or, in other words, make as many DWI arrests as possible. Interestingly, our neighbor to the south recently unveiled a new — and controversial — […]

Nine NFL players were arrested for DWI or DUI related charges between the Superbowl in February and the start of training camps at the end of July. To put this into prospective, at the beginning of training camp NFL rosters are allowed to carry 90 players, which means there are a total of 2,880 players on NFL rosters through most of the offseason. Even though it seems like the news is filled with NFL players under arrest […]
