A 23-year-old Missouri woman who pleaded guilty in connection with a fatal drunk driving accident will not be sent to state prison. Instead, the driver will spend 120 days in a local jail before being released on probation. That sentence was handed down on July 22 in Greene County. The woman was facing a serious DWI charge after being accused of involuntary manslaughter for her role in the fatal crash. Defense attorneys say that the sentence complied with […]

Underage Drinking Still a Problem Despite Changes in Law

On behalf of The Law Office of Jason A. Korner posted in Underage Drinking on Friday, July 25, 2014. Think back to the mid-1980s, when the National Minimum Drinking Age Act essentially required that all states raise the minimum age for drinking to 21. Should we still be supporting that piece of legislation? Experts in Missouri and other states say, “maybe not.” Even though the law was designed to protect teens from fatal vehicle accidents — and drunk driving charges — it seems to have had an unintended effect. That is, more underage drinking is occurring than ever before, despite […]

Missouri Man Sentenced in Hit-and-Run DUI Case

On behalf of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Friday, July 18, 2014. Judges have a difficult job when they are faced with handing out sentences that are fair to the defendant yet punitive enough to satisfy the victims. When a defendant shows genuine remorse for a crime, judges often take that into consideration during the sentencing phase of the process as one Missouri man is now finding out. A 25-year-old man was recently sentenced for the crime of involuntary vehicular manslaughter due to intoxication resulting from an April 2013 incident […]

A combination of the holiday spirit, a long weekend, and people going out to see old friends leads to many impaired drivers on the roads. Law enforcement is well aware of this pattern so there is heightened DWI enforcement on the streets. Starting the Wednesday before, but lasting throughout Thanksgiving Weekend, law enforcement will utilize sobriety checkpoints and DWI […]

Jefferson County Checkpoints to Continue

By Jason Korner of The Law Office of Jason A. Korner posted in DWI Checkpoints on Wednesday, October 23, 2013. Jefferson County’s Council recently voted to reject a $22,000 grant from the Missouri Highways and Transportation Commission to fund Safety Checkpoints. The Council rejected the funding due to concerns over the intrusiveness of these “safety” checkpoints. It is the first time funds of this nature have been rejected by the Jefferson County Council. Although council members seem to support more traditional sobriety checkpoints, they expressed that safety checkpoints were in the best interest of Jefferson County residents. A safety checkpoint […]

One DWI, Two Very Different Breath Tests

By Jason Korner of The Law Office of Jason A. Korner posted in DWI / Drunk Driving Charges on Wednesday, October 9, 2013. “The Officer Had Me Blow Twice in My DWI Case” Frequently during new client consultations for DWI cases I hear, “They had me blow twice.” Usually this means the police officer administered a preliminary breath test at the scene, prior to placing my client under arrest, then administered an evidentiary breath tests once back at the station. There are times when no preliminary breath test is given, and other times when the evidentiary breath test takes place […]
